These Terms of Use (“Terms”) govern your access to and use of the website operated by Mobility & More (“Mobility & More,” “Company,” “we,” “us,” or “our”). By accessing, browsing, or purchasing from this Website, you agree to be bound by these Terms.

You must be at least eighteen (18) years old to use this Website or place an order. By using the Website, you represent that all information you provide is accurate, current, and complete.
Mobility & More currently operates only in the United States. Accessing the Website from outside the United States is done at your own risk and you are responsible for compliance with applicable laws.
2. Relationship to Other Policies
These Terms incorporate by reference our Privacy Policy, Return Policy, Delivery Policy, and any additional terms presented at the time of purchase (“Additional Terms”). In the event of a conflict, the Additional Terms applicable to a specific product or service control.
3. Website Access and Permitted Use
We reserve the right to modify, suspend, or discontinue any part of the Website at any time without notice. We are not liable for Website downtime, interruptions, or technical errors.
You agree to use the Website only for lawful purposes.

6. Pricing and Best Price Guarantee
All prices are in U.S. dollars. Sales tax is calculated at checkout.
Best Price Guarantee
If you find a lower advertised (local) price for the exact same brand-new product (same manufacturer, model, and options) within 5 days of purchase, we may match the difference either by refund or price adjustment.
Conditions:
- Must be sold by an authorized local dealer.
- Online orders do not apply.
- Excludes closeouts, discontinued, refurbished, returned, demo, or older versions.
- Excludes rebates, financing incentives, or promotional discounts.
- Processing may take up to 7 days.
7. Orders and Acceptance
Submission of an order does not constitute acceptance. Orders are accepted only after payment confirmation.
We reserve the right to refuse, limit, correct, or cancel orders, including those affected by pricing errors or suspected fraud.
8. Payment and Financing
Payment must be received prior to shipment unless otherwise agreed.
If third-party financing is used, the financing agreement governs payment disputes, chargebacks, and certain return rights and may supersede portions of these Terms.
We are not responsible for payment processor failures.
9. Shipping, Delivery, and Risk of Loss
Shipping Estimates
Shipping times are estimates and not guarantees.
Risk of Loss
Title and risk of loss pass to the customer upon delivery of the product to the carrier.
Mobility & More is not responsible for carrier delays, freight damage after transfer to carrier, weather events, or circumstances beyond our control.
Delivery Services
Freight deliveries may require appointments, lift-gate service, or additional fees.
White Glove Delivery includes in-home setup and basic instruction. Additional fees apply. Missed appointments may incur charges.
10. Damages and Missing Items
You must inspect shipments promptly.
- Visible damage: Refuse delivery and notify us immediately.
- Concealed damage: Report within 72 hours.
- Missing or incorrect items: Report within 7 calendar days.
Failure to notify within the required timeframes may void claims.
11. Returns and Exchanges
At Mobility & More, our goal is to help you select the right product for your needs the first time. If a product does not meet your expectations, we are here to assist.

Overview
- NO RETURNS accepted after 7 days for most items (must be in new condition).
- NO RETURNS on mobility scooters/electric wheelchairs after 3 days.
- NO RETURNS for broken seals and opened supplies.
- NO RETURNS on any opened bath safety item.
- NO RETURNS on special orders without prior authorization (up to 30% restocking fee plus shipping cost may apply).
- Eligible returns may incur a 20%–30% restocking fee.
- White Glove and delivery charges are non-refundable.
- Open Box items are final sale.
12. Order Cancellations
- 20% for standard orders under $1,000.
- 25% for standard orders over $1,000.
- 30% for custom products.
Refused shipments may incur restocking and freight charges.
13. Repairs and Warranty
Warranty coverage varies by manufacturer. Some warranties cover parts and labor; others parts only.
Expedited service may require additional fees.
14. Safety and Proper Use
Products must be used strictly in accordance with manufacturer’s instructions.
- Read manuals before use;
- Observe weight and size limits;
- Use products only as intended;
- Avoid unsafe surfaces or conditions.
Improper use voids responsibility.
15. Medical and Professional Disclaimer
Mobility & More is not a healthcare provider. Nothing on the Website creates a provider-patient relationship.
Products are not intended to diagnose, treat, cure, or prevent medical conditions unless expressly stated.
Always consult a licensed healthcare professional before purchasing or using medical equipment.
16. Disclaimer of Warranties
THE WEBSITE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, MOBILITY & MORE DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
17. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOBILITY & MORE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.
18. Indemnification
You agree to indemnify and hold harmless Mobility & More from claims arising from misuse of products, violation of these Terms, or violation of third-party rights.
19. Dispute Resolution and Arbitration
YOU WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.
- Binding individual arbitration under the Federal Arbitration Act.
- Class and representative actions waived.
- Arbitration in North Carolina unless otherwise agreed.
- Proceedings confidential.
20. Limitation of Time to File Claims
Any claim must be filed within one (1) year after it arises or it will be permanently barred.
21. Force Majeure
Mobility & More is not liable for delays or failures resulting from events beyond our reasonable control.
22. Severability
If any provision is unenforceable, remaining provisions remain in effect.
23. Assignment
Mobility & More may assign rights without notice. Customers may not assign rights without written consent.
24. Governing Law
These Terms are governed by the laws of the State of North Carolina and South Carolina.
25. Modification of Terms
We may update these Terms at any time. Continued use constitutes acceptance.
26. Entire Agreement
These Terms constitute the entire agreement between you and Mobility & More.
